4. Quotations & Site Visits
- Quotations are prepared based on information shared by the Client and are estimates, subject to revision after a physical site survey.
- Free site visits may be offered at our discretion; specialised inspections, travel beyond our standard service area, or repeat visits may be chargeable.
- Unless stated otherwise, quotations are valid for 15 days from the date of issue.
5. Orders, Confirmation & Service Agreement
- A service is considered confirmed only upon the Client's written or verbal acceptance of the quotation and, where applicable, receipt of the agreed advance payment.
- Installation and service timelines communicated to the Client are estimates and may vary due to site readiness, material/hardware availability, or factors beyond our reasonable control.
6. Pricing & Payment Terms
- All prices are quoted in Indian Rupees (INR) and are exclusive of applicable taxes unless expressly stated otherwise.
- Accepted payment modes include bank transfer, UPI, and any other mode communicated to the Client at the time of service.
- For larger projects, payments may be structured as advance, milestone, and final payments as set out in the quotation or invoice.
- Delay in payment may result in delay or suspension of ongoing or scheduled services.
GST Invoicing
All invoices raised by DIGITECH IT SOLUTIONS are generated with applicable GST, for every type of payment received — including advance payments, part/milestone payments, AMC payments, and final payments. A GST-compliant bill is issued for all transactions.
7. Refund Policy
No Refund After Payment
Once a payment has been made and processed, it is treated as final and non-refundable, except as expressly set out under “AMC & Advance Payment Refunds” below.
AMC & Advance Payment Refunds — 24-Hour Window
Refunds against Annual Maintenance Contract (AMC) payments, or against advance payments received for a service, can only be processed if the refund request is raised within 24 hours of the payment being received by DIGITECH IT SOLUTIONS. Refund requests raised after this 24-hour window will not be entertained.
- Where a refund is approved under the 24-hour window above, it will be processed to the original mode of payment within a reasonable timeframe, less any bank or payment-gateway charges actually incurred by us.
- No refund will be issued once installation, on-site service delivery, or AMC coverage has commenced, or once materials/hardware have been procured specifically for the Client's order — even if this falls within the 24-hour window.
8. Cancellations
- A scheduled site visit or service may be cancelled by the Client free of charge before any payment is made, subject to reasonable prior notice.
- Once a service is confirmed and payment has been received, the Refund Policy in Section 7 applies; requesting cancellation does not, by itself, entitle the Client to a refund beyond what is stated in that section.
9. AMC (Annual Maintenance Contract) Terms
- AMC coverage is limited strictly to the scope of services listed in the specific AMC agreement/invoice, for the period covered.
- AMC does not cover damage caused by misuse, power surges, natural calamities, unauthorised modifications, or third-party interference, unless specifically included in writing.
- AMC renewal is not automatic; the Client will be notified in advance of expiry.
- Refunds on AMC payments are governed strictly by the 24-hour Refund Policy in Section 7.
10. Warranty
- Hardware supplied by us carries the warranty (if any) offered by the original manufacturer or brand, subject to that manufacturer's terms.
- Installation and repair labour carries a limited service warranty as communicated at the time of service. This labour warranty does not cover damage arising after our service due to misuse, tampering, power issues, or the actions of third parties.
11. Client Responsibilities
- Provide accurate site information, safe access, and suitable working conditions for our technicians.
- Make payment in accordance with the agreed terms and timelines.
- Promptly inform us of any issue with a delivered service so it can be addressed within the applicable warranty or AMC period.
12. Limitation of Liability
- While we take all reasonable care in delivering our Services, DIGITECH IT SOLUTIONS shall not be liable for any indirect, incidental, or consequential loss — including loss of data, business, or profits — except where such loss is caused by our proven gross negligence or wilful default.
- Our total liability arising out of any claim relating to the Services shall not exceed the amount actually paid by the Client for the specific service giving rise to that claim.
13. Intellectual Property
Any network designs, configurations, or documentation created by us as part of a Service remain our intellectual property unless otherwise agreed in writing, save for the licence granted to the Client to use them for their own premises.
14. Confidentiality
Both parties agree to keep confidential any non-public business, technical, or security information shared in the course of the engagement, and to use it solely for the purpose of delivering or receiving the Services.
15. Force Majeure
We shall not be held responsible for any delay or failure to perform our obligations arising from causes beyond our reasonable control, including but not limited to natural disasters, strikes, government restrictions, or supply-chain disruptions.
16. Termination
Either party may terminate an ongoing service agreement by written notice, subject to settlement of any outstanding dues for work already performed or materials already procured. The Refund Policy in Section 7 continues to apply to any payments already made.
17. Governing Law & Jurisdiction
These Terms shall be governed by the laws of India. Subject to applicable law, any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts at Bulandshahr, Uttar Pradesh.
18. Amendments to These Terms
We reserve the right to update these Terms & Conditions at any time. Continued use of our website or Services after any changes are posted constitutes acceptance of the revised Terms.
